3、Qualification Requirements For Bidder
Qualifications or Performance:The Bidder shall submit with its Technical Bid the following additional documents:
1) In the case of a bidder offering to supply goods under the contract which the Bidder does not manufacture or otherwise produce, the Bidder has been duly authorized by the goods' Manufacturer or Agent (the agent must provide copies of valid certificate issued by the manufacturer) to supply the goods in this bidding project, the format of "Manufacturer's Authorization" as per Section 4 Bidding Forms and the Manufacturer's Authorization must be original; and together with other supporting documents (such as Manufacturer Qualification Statement, etc.) required in the BD.
2) The bidder must have completed at least 2 medical equipment supply projects financed by foreign government loan or international financing institutions with a minimum contract amount of not less than EUR 3 million (or equivalent in USD or equivalent in CNY) each from 2016 to 2018. Relevant proof shall be presented as follows: a) copies of Notification of Award of Contract; and b) copies of supply contract which include the home page, price page, signature page, equipment list page (price information could be deleted) and end-user's contact information; and c) copies of Acceptance Certification issued by the end-user. The date of Acceptance Certification should be within the stipulated period. In addition, the above mentioned documents shall be stamped by bidder with its official seal.
3) The bidder must provide following supporting documents:
a. The bidder must be legally registered independent Legal Person, must provide the copy of Business License.
b. The domestic bidder must provide the copy of valid Medical Instrument Business Enterprise Permit.
c. The bidder must provide SFDA registration certificate for medical devices.
d. Average annual turnover of EUR 18 million (or equivalent in USD or equivalent in CNY) in the past three years (2016-2018) in medical equipment sales and have a minimum equity of EUR 1 million (or equivalent in USD or equivalent in CNY); shall be proved by audited Balance Sheet, Income Statement and Cash Flow Statement of 2016-2018. The bidder shall prepare a separate document to demonstrate breakdown of their annual turnover of medical equipment sales. This separate document shall be signed by the accountant or director and certified by a public auditor or notary agent and supported by the relevant supply contracts. For contract, copies of home page, price page and signature page of the contract shall be provided and other contract information shall be available for checking.
e. The bidder must provide the copies of audited Annual Audit Report from 2016-2018.
f. The bidder must continuously in business at least 5 years (from 2015 until now), as per establishment date on legal business license or registration license; the Bidder must provide the copy of business license or registration license (the bid will be rejected if date of establishment on the license is not recognizable).
g. The bidder must provide an original proof documents from the bank to prove its credit line no less than EUR 10 million (or equivalent in USD or equivalent in CNY); at the same time, the bidder must provide a statement for its current contracts commitments and the usage amount of credit line (the statement should include the bidder's current contracts commitments, the usage amount of credit line, the remaining amount of credit line and etc.); the remaining amount of bidder's credit line should be no less than EUR 6 million (or equivalent in USD or equivalent in CNY); and the bidder should promise using at least EUR 4 million (or equivalent in USD or equivalent in CNY) credit line for this project if wining the contract.
Or, the bidder must provide an original proof documents issued specifically for this project from the bank to prove its credit line no less than EUR 4 million (or equivalent in USD or equivalent in CNY).
h. The bidder must provide an original commitment letter to confirm that will not free to replace (the bidder can report to the relevant departments for the record and consent, and then apply for changing the project manager if he/she sick or quit job) the project manager during the Contract implementation process.
4) All parties involved in a procurement process financed under German Financial Cooperation must ensure a fair and transparent competition and at least observe those ILO Core Labor Standards that have been ratified by the developing country. This must be documented by a corresponding declaration of undertaking of all parties involved in the bidding process. The Bidder is required to submit a Declaration of undertaking (Please see Section 4 Bidding Forms for the format). The Declaration of Undertaking must be signed in a legally binding manner by duly authorized representatives of the bidder. Failure to submit this declaration and non-compliance with the requirements will lead to exclusion from the tender.
Note: Non EUR currency will be converted by the benchmark price announced by the Bank of China on the date of issue the bidding announcement.
